C-JeS Entertainment has responded to recent rumors concerning JYJ\'s previous "slave contract" with SM Entertainment.

As previously reported, JYJ filed a lawsuit against SME in July of 2009, and the lawsuit ended in 2012 with both sides reaching an agreement. The documents from the case were recently revealed, and based on the documents, some are saying the slave contract assertions are false.
C-JeS Entertainment has now responded with their own statement on the matter on the agency\'s official website. The label stated, "False postings about the preliminary injunction order for the invalidation of the exclusive contract obtained by JYJ against SM Entertainment Inc. (\'SM\') in 2009 and the conciliation reached in 2012 between JYJ and SM have recently swept the Internet.  As such postings have caused confusions among fans at home and abroad not fully aware of the factual background, C-JeS Entertainment Corp. (\'C-JeS\') will explain JYJ\'s position below to avoid any further confusions."
The label then recounted court proceedings between JYJ and SM, affirming, "The court ordered that \'SM shall not, contrary to JYJ\'s will, negotiate or enter into a contract with a third party for JYJ\'s appearance in any TV program or movie, their participation in any performance or concert, their production of music records or their participation in any entertainment event or activity, or request third parties, including broadcasting companies, music production companies and concert agencies, to terminate their relationship with JYJ to interfere with JYJ\'s engagement in any entertainment activity.\'"
When SME filed an objection, the courts found SM AND JYJ had an "exclusive contract on a subordinate relationship," and that a long-term contract such as that could not be justified. C-JeS concluded it will be taking legal action on JYJ\'s behalf against those who disseminate these groundless rumors.
Take a look at C-JeS\' rebuttals to the rumors below:
① Some people alleged on the internet that the exclusive contract between SM and JYJ was not unfair on the grounds that the settlement amount SM paid to JYJ was smaller than the amount originally claimed by JYJ, and that SM paid such amount to JYJ only to settle the amount that should have been paid to JYJ in 2009 but was not paid due to the lawsuit.  However, JYJ agreed to reduce the settlement amount in order to settle the dispute as soon as possible, fearing protracted litigation will only waste the time and money and may make it impossible for JYJ to take part in the entertainment business of their own will for the litigation period.  
② Other people alleged on the internet that JYJ executed the 13-year long-term exclusive contract at the request of TVXQ members\' parents.  The court, however, found that the members\' negotiating powers were at their lowest at the time they signed their exclusive contract, which was right before the release of their debut album on January 14, 2004, and it is unfair and against good moral and public order for SM to have JYJ sign a long-term exclusive contract taking advantage of the situation where there is no alternative choice.  
③ People also alleged on the internet that the Korea Fair Trade Commission\'s order to take corrective measures is only applicable to those contracts between SM and its trainees.  In fact, the Korea Fair Trade Commission has repeatedly issued orders to take corrective measures with respect to the exclusive contracts between the entertainment agencies and their entertainers.  The controversy on the fairness of such contracts became widespread after the problems and issues related to the contracts between agencies and their trainees were raised.  
Keep in mind low IQ\'s that SME would have HAD to support JYJ for 13 years if they did poorly.  that contract works both ways.  JYJ at the time probably signed it because it gives them security at probably a very modest cut of profits, but they were much more humble at the time so were i\'m sure happy to have that security knowing SME would have to support them for 13 years regardless if they did good or bad.  Junsu comes from a lawyer family so its not like they\'re all so clueless.  its just that fame goes to their heads when they see SM making a lot more than they\'re being paid a cut of.  but again that could have very well been a reversed situation where SME were stuck with failures for 13 years and had to continue to support them while bleeding money.  for ex. if Nueste had signed a 13 year contract they wouldnt be auditioning on some talent show right now, they\'d still be supported by their agency and making music in further attempts to hit it big.
What support? They did not had any salaries, insurances or guarantees in their contracts. They were get paid from profits and if company did not showed profits they got nothing. And in their contract SM did not had any responsibility to keep them if they failed, company could just to throw them away if wanted (after getting from them all debts and investments) or to sell or lease them to other company. And all this without their agreement. Don\'t compare old contracts with contracts that were made with KFTC standard form of exclusive contract. And you continue to spread false information even after this article and even court documents said why they signed their contracts - because it was the only contracts that were given them. They did not had alternative choice. In that years SM gave such contracts to all their new artists.

The line that really stood out to me was the part where the judge said "The members\' negotiating powers were at their lowest at the time they signed their exclusive contract." People keep saying that they broke their contract and that they have to pay the price but they don\'t understand that a lot of trainees sign these long term contracts when they\'re really young and don\'t understand how to negotiate and don\'t know what\'s fair and what\'s not. Agencies know this and will use this to benefit themselves. JYJ were teenagers when they signed this contract and had no idea how SM was going to treat them. To have a 13 year exclusive contract is ridiculous. That means for 13 years, none of the terms of the contract will change, and SM can continue to do whatever the hell they want with them while still making a huge profit and the only way out would be a lawsuit. If you look at Big Bang, they renew their contract every 5 years and each time the terms of the contract gets better and better (like the pay cut increases, etc)  but if JYJ stayed with SM, nothing would change for 13 years.
No thats a very bias way of looking at it. JYJ at the time before their big success probably wanted security and didnt care so much about a big pay day/cut in their profits. Don\'t forget that everyone is a lot more humble before they hit it big. The question u should ask yourself is what if they didn\'t do well? they would have still been under contract that SME would\'ve had to honor and keep pushing to support them for the duration of that 13 years. that 13 years works both ways. you\'re ONLY viewing it with after the fact perspective and not the real conditions in which that 13 year contract was signed where nobody was sure they would blow up like they did. So in JYJ\'s benefit to signing for 13 years JYJ would\'ve had SME\'s support regardless of JYJ doing poorly which obviously would\'ve hurt SME. they didn\'t HAVE TO sign that contract but they did and very likely for long term security when they were much more humble than when fame got to their head. just like the EXO rejects that left to China to make more money but were much more humble when they were nobody\'s and happy with their initial contract to even pursue their dream. I get why the government stepped in and reduced the amount of years their contracts can be signed for since 13 years is a long time but don\'t pretend that 13 years couldnt have screwed over SME as well when groups dont do well. Lets say Nuest signed a 13 year contract, they couldnt just be dropped into obscurity and the agency would\'ve had to keep supporting them for 13 years.
being signed doesn\'t mean the agency will support you with quality releases and lots of work. no matter your popularity, you can be sent to a dungeon and have releases every two years or more. look at f(x) or henry. i don\'t see SM taking a risk when they sign an artist. and i\'m pretty sure there are terms that would let them get rid of an artist if it\'s not profitable, but not the other way around.
Having a 13 year contract does not mean that you will be unconditionally supported. Amber has said herself that she went out to get jobs on her own because SM didn\'t have work scheduled for her. So if JYJ didn\'t make a profit, SM would keep them around and do nothing for them. They would not invest their money into them but instead create a new group and focus on them. SM doesn\'t care if a group dies out because they see their artists as being easily replaceable. The whole concept of NCT revolves around that.
One more thing I hope those HoMin stans who are still trying hard to harm JYJ just move on the 5 boys are in good terms and I\'m sure both Yunho and Changmin must be ashamed right now to even look at JYJ members face because of what their stans did to JYJ here...it\'s been 7 years already, SM and JYJ lawsuit is between SM and JYJ HoMin and their fans should just stop putting their noise in it everytime. Go love your oppas more and use your precious time on them and leave JYJ in peace.
Nobody believed those idiotic rumors anyway but allkpop you are not innocent either, you knew those were just HoMin stans false rumors but you called them official doucuments. Cjes once again shared all the documents of the lawsuit (that were already existent from ages ago)....not some made up summary... I heard HoMin stans already started deleting their false articles  now lmao Junsu\'s korean fans already took pictures they are dead this time, they deserve to be sued to be honest because despite what they did was so stupid that any sane person knew that it was all lies but it was still serious and they deserve to get punished. Is JYJ not going through enough bull shit already?? Not being able to perform on music shows, not being able to appear on tv shows and how they aren\'t even invited on Award ceremonies, I get so upset remembering how Jae wasn\'t even given a seat at golden disk award when he was one of the most senior idols over there, Haters need to take a chill pill, JYJ have been suffering a lot because of SM so why can\'t haters just shut up and leave them alone. JYJ and TVXQ have been walking separate paths for the last 8 years so can people stop hating on both the groups, they chose their different paths so Homin stans stop hating on JYJ and JYJ stans stop hating on the present TVXQ

it seems u have no idea how much hate Yun and Min got before when the split happened, but yes its true I\'ve seen more antis of JYJ than of TVXQ here in allkpop but all those things in the past dont matter. I just wish people would stop fighting and stop blaming each other.

can we pls finally stop calling these "slave contracts"? let us call them "unfair contracts". those idols dont want to be called slaves, they said so themselves. and after what happend to sment with the contract issue, every entertainment company had to change their contracts, not only sment. so dont always give sment all that shit only. slave or not JYJ can\'t even perform on music show normally like others band, cant even appear on any variety shows all because of SME backdoor dirty pressure, the boys are still hurt by SME motive even though the case has been over.
