Doctor_banana, I had to notice that you have that same actor in your icon (yeah, I know it's from a different show).. Next thing you'll be saying you're not biased, huh? :)
Well, no one really deserves that, but seeing as he is a death eater (mass murderer and stuff), I guess that in JKR's world that means he does. Plus holding Moody in a box for a year...
of course I think he deserved a punishment.. like being locked up in azkaban.. but i don't think anyone deserves having their soul sucked out, it's horrible.. plus if they hadn't done it, the truth of voldemort's return would have come out much sooner
But if he'd've gone to Azkaban, he'd've been let out by the Dementors later anyway, and gone on to do more murderous things. At least with no soul he's no use to Voldemort.
He was too intelligent and too sly to be kissed by dementors. Besides, pretending to be Mad Eye for the whole year is enough punishment. Just imagine being Moody... terrible
As vast majority keeps saying; no one deserves that kind of a fate. No one. But that's not the only point I wish to make.
1. Yeah, sure, he MAY have participated in the unspeakable torture of the Longbottoms but that is not confirmed in the book at any point, so you can't really sentence him to that kind of a punnishment for that. As he might have as well been innocent.
2. He was dying in Azkaban within a year. So he obviously wasn't too devoted and fanatic for Voldemort. Thus he head some good in him yet.
3. He killed his own father. But we don't know how he REALLY felt about it in the deepest. He wasn't sane when he did that.
4. Yes, he was a Death Eater but simply for being such, isn't that bad of a crime - if it was, they wouldn't be just sent to Azkaban nor would the Ministry have even consideref setting Karkaroff free for only betraying some other Death Eathers.
5. Not to mention that the only crimes he's guilty of for sure, he commited while emotionally and physically extremely damaged.
X So no - he definitely did not deserve to have his soul sucked out. I wouldn't say he'd even have deserved to die because of all the same reasons I just analysed. But just that death would've been a mercy to him while also rid the world off of him - and that way everyone would've benefited from it.
This of course wasn't the view of the Wizzarding sociaty which seemed to be very cruel and extreme with it's outlaws until the end of the second war.
I just wish people paid more attention to BCJ's depth. And saying he deserved to have his soul sucked out certainly isn't doing so. :/
Well, I am extremely biased by my love for him as the Doctor. However, my answer is still no. Life without a soul is worse than death and I don't think he deserved that. Plus, who knew about motives behind what he did. Now i'm thinking of Loki...... Just 'cause some unintentional things can turn a person to the dark side quite easily. You remember how in the book how somebody said that Crouch Sr. should have payed more attention to his son? Think about it, his dad doesn't care about him, who knows about his mum, he could very possibly have turned to the dark side because he thought he might be able to belong there. Also, we don't know which of the crimes he was accused of he actually committed.
Well, yeah. He totally deserved it, but considering that Fudge allowing that to happen meant that Harry and Dumbledore had no proof Voldemort was back, it was a terrible idea.
Prisoner of Azkaban, p183:
Lupin: "You'll just exist. As an empty shell. And your soul is gone for ever... lost" "It's the fate that awaits Sirius Black"
Harry: "He deserves it"
Lupin: "You think so? Do you really think anyone deserves that?"
The above passage points out that even when Lupin thought that Black had committed unspeakable atrocities- the betrayal of the Potters which ultimately led to their murders, the massacre of 12 innocent Muggles- he still doesn't think he's deserving of the Dementor's Kiss. And I really think JK Rowling's using Lupin as her mouthpiece here, in the context of him never failing to dispense wise advice throughout the books. It makes sense- she's a strong advocate of human rights, against capital punishment such as the death penalty. And the Dementor's Kiss is mentioned elsewhere as being "WORSE than death". I'm honestly surprised at the amount of 'yes' votes here. No one, no matter what their crime, should be subject to it.

And no one deserves that punishment, the same goes for death penalty
